Our respect for intellectual property

Jess & Co. Real Estate respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA” — 17 U.S.C. § 512), we will respond promptly to clear notices of alleged copyright infringement involving content on jessicaberchtold.com.

Reporting alleged infringement

If you believe that material available on this website infringes a copyright you own or control, you may submit a written notice (a “DMCA Notice”) to our Designated Agent listed below. To be effective, your notice must include all of the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing, with enough detail (such as the URL) for us to locate it.
  • Your contact information — name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

What happens next

Upon receiving a valid DMCA Notice, we will remove or disable access to the allegedly infringing material within a reasonable time and, where appropriate, notify the party that posted it. We may also terminate, in appropriate circumstances, the access of users who are repeat infringers.

Counter-notification

If you believe material you posted was removed by mistake or misidentification, you may send a written counter-notification to our Designated Agent that includes:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for your district (or the Eastern District of Missouri if outside the U.S.) and will accept service of process from the complaining party.

Listing photos & MLS / IDX content

Property listings, photographs, and related data shown in our search tools are provided through Internet Data Exchange (IDX) feeds from local Multiple Listing Services and the listing brokerages that own them. If your complaint concerns a specific MLS listing or its photos, the fastest resolution is usually to contact the listing brokerage or MLS directly; you may also notify our Designated Agent and we will route the request to our IDX provider.

A note on accuracy

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing — or was removed by mistake — may be liable for damages. If you are unsure whether material is protected by copyright, you may wish to consult an attorney before submitting a notice.
